The terms, in plain English

These terms apply to every sale, purchase, sourcing brief, part exchange, consignment and service arranged through Wristly. They are written to be read rather than skimmed. Nothing in them takes away rights you have as a consumer under UK law.

01About us and these terms

By enquiring, placing an order on this website, paying a deposit, or asking us to buy, sell, source or service a watch you agree to these terms. Where a specific written agreement is made - a consignment agreement or a sourcing brief, for instance - that agreement applies alongside these terms and takes priority where they differ.

02Descriptions, prices and availability

Every watch is described from our own inspection. We take care to be accurate, and we name marks, replaced parts and polishing where we find them. If you find that a watch is not as described, section 7 applies.

Prices are in pounds sterling. Where a watch is sold under the VAT margin scheme no VAT is shown separately and none is recoverable; where standard VAT applies, the listing and invoice say so. Prices exclude delivery unless stated; delivery is shown separately before you pay online. Prices can change until a deposit has been paid or an online order confirmed.

A watch marked available is in stock at the time the page was published. Because the same watch may be under discussion with more than one customer, it is not reserved for you until a deposit has been received and confirmed by us, or until you check out online (section 3).

Until product photography is in place, listings may show a rendered image of the watch’s configuration rather than a photograph. Photographs of the specific watch are supplied on request before any deposit is taken.

03Reserving and paying

Buying online

Where a watch can be bought online, it is held for you from the moment you proceed to payment until the payment page expires (the time is shown at checkout). Card and other payment methods are processed by our payment provider, Stripe; we never see or store your card details. The contract is made when your payment is confirmed and we send the order confirmation email. If a payment is declined, abandoned or fails to clear, no contract is made and the watch is released.

If a watch is sold to someone else before your payment completes, or a payment reaches us after the hold has ended and the watch is no longer available, we will refund you in full and tell you straight away.

You can ask to cancel an online order before it is dispatched from your account or the link in your confirmation email. A refund, where due, is made to the original payment method; we email you when it is sent and again when the payment network confirms it.

Reserving by deposit

A sale is agreed when we confirm in writing (email or message) that a deposit has been received and the watch is reserved for you. The deposit is normally ten per cent of the price and holds the watch for an agreed period, typically seven days, while you view it or arrange the balance.

The deposit is refunded in full if the watch is not as described when you see it. If you simply change your mind about a watch from stock, the deposit is refunded less any costs we have incurred at your request (such as a service or bracelet work). For a watch sourced to your specification, the deposit may be retained if you withdraw after we have committed to buying it; this will be made clear before you pay it.

The balance is due before dispatch or at collection, by bank transfer, by card in person, or by online payment where we offer it. Title to the watch passes to you when payment has cleared in full.

04Delivery and collection

Watches are sent by fully insured, tracked courier requiring a signature, to the billing address or another address agreed with us in writing. Packaging is discreet. Dispatch is normally the same or next working day after cleared payment, for next-working-day delivery within mainland UK; we avoid dispatching for weekend delivery unless you ask.

Risk in the watch passes to you when it is signed for. Please check the parcel before signing if it shows any sign of damage, and tell us within 24 hours of any problem so an insurance claim can be made.

Collection in person from Llanelli is by appointment and free. Photographic identification is required at collection.

Delivery outside the UK is by arrangement only. The buyer is responsible for import duties and taxes at destination, and the distance-selling return in section 6 applies to those sales too.

05Returns and cancellation

Distance sales

If you buy a watch without having seen it in person, the Consumer Contracts Regulations 2013 give you the right to cancel for any reason within fourteen days of delivery. Tell us in writing within that period - for online orders you can request a return from your account or from the link in your order email - then return the watch within a further fourteen days. It must come back complete, unworn beyond examination, with all stickers, box, papers and accessories as supplied. You are responsible for the cost of return and for insuring it in transit; we will arrange the courier on request and deduct the cost from the refund. Refunds are made within fourteen days of the watch being received back, less any deduction for handling beyond what is needed to examine it.

Sales in person

A watch bought after examination in person is not returnable on a change of mind, but section 7 applies in full if it turns out not to be as described.

Sourced watches

A watch bought to your specification through the sourcing service is a distance sale if you have not seen it, and the fourteen-day right above applies.

06Authenticity guarantee and warranty

Authenticity. We guarantee that every watch we sell is genuine and that its principal components (case, movement, dial, hands and bracelet) are as described. If a watch we have sold is shown by a competent independent authority not to be genuine, or to contain undeclared non-original principal components, we will refund the full purchase price on its return. This guarantee has no time limit and passes to subsequent owners.

Mechanical warranty. Pre-owned and modern watches are supplied with a twelve-month warranty against mechanical failure from the date of purchase, covering the movement and its repair or replacement at our discretion. New, unworn watches are covered by the manufacturer’s warranty instead, and the card is supplied unregistered or registered as stated. Vintage watches (generally pre-1990) are sold as running and correct at the date of sale, and are covered for three months, reflecting their age.

The warranty does not cover water ingress on a watch not rated for it or whose gaskets have not been tested by us, damage from impact, misuse or unauthorised work, wear to straps, bracelets and crystals, or accuracy variation within the manufacturer’s tolerance. Work under warranty is carried out by us or by watchmakers we appoint; a watch taken elsewhere first is no longer covered.

Consumer Rights Act 2015. Nothing above reduces your statutory rights. Goods must be as described, of satisfactory quality (taking account of age and description) and fit for purpose.

07If a watch is not as described

Tell us as soon as you can. Return the watch, at our cost, and we will inspect it. Where the description was wrong, you choose between a full refund including delivery costs, a repair, or a price reduction. Where the description was right and the issue arose afterwards, the warranty in section 6 applies. We will always explain what we found.

08When we buy your watch

A valuation is a written offer to buy, valid for the period stated (normally fourteen days), conditional on the watch being as described and on our inspection. By offering a watch for sale you confirm you are its legal owner, that it is free of any finance or claim, and that you have the right to sell it.

We are required to see photographic identification and proof of address, and to keep a record of the purchase. Payment is by bank transfer once the watch has been inspected and found as described. If it is not, we will tell you what we found and either revise the offer or return the watch to you at our cost.

Part exchange is treated as a purchase of your watch and a sale of ours, on these terms, with the two figures set off against each other.

09Consignment

Consignment is governed by a separate written agreement setting out the asking price, the reserve below which we will not sell without your consent, our commission, the consignment period and the notice needed to withdraw. Until sold, the watch remains your property and is insured under our policy while in our care and in transit arranged by us.

Settlement is made by bank transfer within seven days of the buyer’s funds clearing and any return period expiring, with a statement showing the sale price, commission and any agreed costs. Where a watch is returned by the buyer under section 5, it is returned to consignment or to you, at your choice.

10Servicing and other work

All work is quoted in writing before it starts, and no further work is undertaken without your agreement. Watches in our care for service are insured under our policy, including while with the watchmakers we appoint. Turnaround times are estimates; parts availability for older references can extend them and we will keep you informed.

Work is warranted for twelve months against defects in the work done. It does not cover unrelated faults or parts not replaced. Watches not collected or returned within three months of notice that they are ready may incur storage charges.

11Liability

We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care, up to the price you paid for the watch or the work in question. We are not responsible for losses that were not foreseeable, for loss of profit or business, or for anything caused by events outside our reasonable control.

Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow us to limit.

12General

These terms are governed by the law of England and Wales and any dispute will be dealt with by the courts of England and Wales, unless you live in Scotland or Northern Ireland, in which case you may bring proceedings in your local courts.

If any part of these terms is found to be unenforceable, the rest continues to apply. A delay in enforcing a term is not a waiver of it. Our privacy policy explains how personal information is handled and forms part of these terms.

If a dispute cannot be resolved between us, you may refer it to an alternative dispute resolution provider; we will tell you which one on request.
